Name changes and name assignment for persons of legal age and underage persons:
The change of the surname of a person must take place either by way of a name assignment at the registry office or as an official name change at the district administrative authorities.
Grounds for name assignment at the registry office:
If the surname of the parents or a parent changes, e.g. due to marriage, re-adoption of a former surname, or name change, this surname can be assigned at any Austrian registry office.
The person(s) entrusted with care and upbringing can submit the application for underage persons. Children above the age of 14 who are capable of sound judgements must select the name themselves.
Grounds for a name change by the district administrative authorities of the place of residence:
The grounds are clearly specified in the Name Change Act, e.g. if the former family name is absurd or offensive or difficult to pronounce, etc. For underage persons, the application is made by the legal representative. Persons between the age of 10 and 14 have a right to be heard. Persons over the age of 14 must consent to the name change.
The first name of a person may only be changed by the district administrative authorities.

- Proof of citizenship
- Proof of academic degrees
- For underage persons: Proof of legal guardianship
- Valid photo identification
of all persons involved.
